Hengeler Mueller appoints four new partners and four new counsel

Hengeler Mueller is strengthening its partnership with the appointment of four new partners and four new counsel: Maximilian Bülau (Frankfurt), Markus Ernst (Munich), Antonia Hösch (Frankfurt) and Daniel J Zimmer (Düsseldorf) are appointed as partners with effect from 1 January 2020. At the same time, Johannes Baumann (Frankfurt), Alexander Bekier (Berlin), Susanne Koch (Düsseldorf) and Moritz Rademacher (Düsseldorf) will become counsel at Hengeler Mueller.

Maximilian Bülau's practice covers a broad spectrum of complex commercial litigation, international and national arbitration and alternative dispute resolution issues. He focuses on securities litigation as well as contract and corporate law disputes. Large cases where Maximilian is currently advising include the defence of a listed company against damage claims, based on allegedly false capital market information, and the defence of claims raised in connection with a public takeover. Furthermore, Maximilian represents national and international clients in post-M&A disputes before courts and arbitral tribunals.

Markus Ernst advises on tax issues in connection with transactions, reorganisations, financing transactions, tax audits and contentious proceedings. In addition to tax law issues arising in M&A transactions and reorganisations, he also focuses on assisting financial institutions in tax-driven internal investigations. His clients include German and foreign companies, financial institutions and private equity firms. Most recently, Markus advised Elanco Animal Health on the acquisition of Bayer Animal Health, Deutsche Börse on the creation of a new index and portfolio / risk analytics provider and VTG on the acquisition of NACCO Group.

Antonia Hösch represents companies in complex disputes before state courts, in international and national arbitration proceedings and in alternative dispute resolution processes. She focuses on commercial and corporate law disputes (including post-M&A matters). Antonia also advises in antitrust related matters as well as in disputes concerning banking liability and in relation to claims against insurers. Among her clients are companies in the financial, telecommunications and automotive sectors as well as a foreign state.

Daniel Zimmer specialises in all areas of competition and energy law. In energy matters, he supports investors and energy supply companies in M&A transactions and advises clients on regulatory issues. In competition matters, he mainly focuses on the representation of companies in cartel damage claims and their extrajudicial conflict resolution. Daniel also represents companies in cartel proceedings before cartel authorities and the courts, and advises clients on antitrust compliance issues. His clients in the energy sector include First State Investment, Ørsted and TenneT. In competition matters, he supports, among others, Pilkington and MAN in their defence against cartel damage claims.

Johannes Baumann advises on M&A transactions, including complex corporate reorganisations, and on corporate matters, representing corporate clients as well as private equity and other financial investors. Most recently, he was involved – among other matters – in the acquisition of Kathrein's antenna and filters business through Ericsson and Bain Capital's sale of a participation in Wittur Group to Canada's Public Sector Pension Investment Board.

Alexander Bekier advises on a broad range of corporate matters and corporate reorganisations as well as M&A projects. His practice also includes capital markets work, in particular in connection with M&A transactions. Additionally, Alexander's practice covers representation in legal disputes with a focus on directors' liabilities issues. Most recently, he was involved in the sale of selected US Linde assets to a consortium, comprised of Messer industries and private equity firm CVC, and the establishment of an independent German media group by funds advised by KKR.

Susanne Koch specialises in public law and advises investors, companies, associations and the public sector on all public law and regulatory matters involving both European and national law. In addition, she is an experienced litigator who represents clients in administrative proceedings and legal disputes. Susanne also advises companies and financial investors on all public law issues in M&A projects. Her most recent mandates include Elanco Animal Health's acquisition of Bayer Animal Health and ZEAL Network's takeover offer for Lotto24.

Moritz Rademacher has a broad public law practice and advises investors, companies and public sector entities in all public law matters. He has a particular focus on the energy sector and other regulated industries, aviation law, banking regulatory matters, product and food law, mining and environmental matters as well as European law. In addition, he represents clients in administrative proceedings and legal disputes before specialised courts, in particular in damages proceedings and administrative disputes.
