Hengeler Mueller advises Hypo Real Estate on Portfolio Transfer to Liquidation Agency

Hypo Real Estate Group has transferred loans, securities, derivatives transactions and other assets and liabilities to FMS Wertmanagement, a liquidation agency established by the German Financial Market Stabilisation Agency under the German Financial Market Stabilisation Fund Act. The portfolio comprises about 12,500 individual positions relating to 70 different legal systems and has an outstanding nominal amount of EUR 173 bn (excluding undrawn commitments and derivatives). The transaction was the largest of its kind in Germany.

Hengeler Mueller acts as counsel to Hypo Real Estate Holding AG and Deutsche Pfandbriefbank AG.
