Hengeler Mueller successfully represents YouTube in defense against damage claim brought by GEMA
29. January 2016
YouTube was again successful in its legal dispute with GEMA: On January 28, the Munich court of appeals rejected the damage claim brought by GEMA against YouTube and thereby confirmed the judgment of the Munich regional court of July 2015. The court of appeals decided that YouTube does not owe copyright fees to GEMA as, under copyright law, the users uploading videos to the platform are responsible for making the videos available to the public. GEMA intends to appeal the decision before the Federal Court of Justice.
Hengeler Mueller represents YouTube in the legal dispute together with the law firm Taylor Wessing. The Hengeler Mueller team included partners Albrecht Conrad and Wolfgang Spoerr, counsel Fabian Seip as well as associate Antonia Wegner (all Copyright Law, Berlin).
