Fabian regularly represents and advises companies in the media, technology and communications industries on agreements, transactions and in important litigation before courts and regulatory authorities.
He represents user associations, internet platform providers, cable network operators and other intermediaries in negotiations and proceedings with collecting societies before the Copyright Arbitration Board at the German Patent and Trademark Office (and ensuing instances). He frequently provides advice on the design and market entry of new business models in this context.
Fabian helped Freenet in its acquisition of the broadcasting services provider MediaBroadcast and advised on the setup of a new digital TV and video platform (copyright and media law) as well as the conclusion of a long term agreement on the use of a dedicated glass fibre network. He advised on the acquisition of a local cable network operator by a national operator and the sale of DTAG's interest in the Scout group, as well as the IPO of the Scout group (IP/IT) (2013 and 2015).
In software, data protection and e-commerce, Fabian represents and advises clients on IP/IT topics, in arbitration procedures on a software based toll collecting system as well as the extension of the system. He has advised a leading vendor of enterprise software on the introduction and distribution of new database software offerings as well as the market introduction of a mobile app based content offering in Europe (IT law, data protection). Fabian further advised Redknee on IT law matters in the acquisition of the BSS business (software for mobile network providers) from NSN, and on the implementation of the transaction through various software agreements.
